NCWM Approves Labeling Changes To Protect Agriculture Equipment

With agriculture season in full swing, tractor hydraulic and transmission fluids are a hot topic. But an even hotter topic in the industry are regulations from the U.S. National Conference on Weights and Measures (NCWM) regarding the quality of fluid and labeling requirements in order to protect equipment from being damaged by low-grade hydraulic products.

Regulations

NCWM regulations require that hydraulic fluids that do not meet current OEM requirements must be labeled as “obsolete” and include a legible warning label on all packaging. The regulations were implemented to ensure that hydraulic fluid brands were not misrepresenting their products and potentially causing damage to consumers’ equipment. 

Failure to comply with these regulations has resulted in class action lawsuits with claims that mislabeled fluids of outdated quality for certain machines were misleading and damaged equipment after use. More specifically, the suit claims products were being labeled and sold as 303 fluid for use in older tractors and equipment, and also that the 303 specification was discontinued 40 years ago by John Deere.  

Now the NCWM will include in its next NIST Handbook 130 that the language, ‘significant harm to the transmission, hydraulic system, seals, final drive or axles is possible when using this product in applications in which it is not intended’ must be included on a product’s packaging if it does not meet current OEM specifications. 

According to the regulations, hydraulic and transmission fluid products that don’t contain this language must be able to prove that they meet OEM requirements.
